Nature's Sunshine among targets of Neways lawsuit

SPRINGVILLE — Neways International filed a lawsuit Monday in U.S. District Court in Salt Lake against Nature's Sunshine Products Inc. of Spanish Fork, including its Synergy division, and Advantage Marketing of Salt Lake and St. George.

Neways claims that Nature's Sunshine, through its Synergy division, copied Neways' top-selling product, Maximol Solutions, and promoted its product through false advertising, trade-dress infringement and unfair competition. Synergy obtained the infringing product from Advantage Marketing, Neways alleges.

Neways is seeking an injunction barring the defendants from falsely representing themselves as owning patents, licenses or rights to Maximol Solutions; from using any product image, name or mark that may be confusingly similar to the Maximol product; from distributing or selling any product that was developed using Neways' confidential information; and from otherwise unfairly competing with Neways.

The suit also seeks seeks damages and disgorgement of profits.
