What Clair is saying is that even though the MSHA lawyers bungled the case, he is claiming victory because the wording buried in the opinion says what everybody knows -- ventillation is good.

This is the best and brightest of the MSHA lawyers, who lets citations for fatalities get tied up in court for 8 years then makes such a ridiculous statement.
