At least it still applies in the courtroom, it seems, while Congress and the Executive branch get a pass.

Bravo to Judge Lamb! Justice has prevailed (at least so far) in this case. The buyout firm, Apollo, led by Leon Black and Josh Harris, operates on a culture of dishonesty and deceit in order to achieve their goals. As a money manager focusing on mergers & acquisitions risk arbitrage (investing in the shares of companies that are targeted in mergers/takeovers), our investment team puts great reliance on the contracts that belie such deals. The contract agreed to by Huntsman and Hexion (Apollo) was unusual in that it provided for no easy exit for the buyer in the event financing was unavailable or the fundamentals of Huntsman deteriorated. Huntsman's board insisted on these strict terms, in part, I believe, because their prior experience with the Apollo organization led them to believe that Apollo walked a fine line when it came to honesty, ethics, and trust.
